Welcome to Tendily. These Terms of Service ("Terms") are a binding contract between you and Tendily LLC ("Tendily," "we," "us," or "our"), a Michigan limited liability company, and govern your access to and use of the Tendily applications, websites at tendily.com and tendily.app, and related services (together, the "Service"). By creating an account, joining a household, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.
You must be at least 18 years old to create an account and to be the account holder for a household. By creating an account, you represent that you are an adult, that the information you provide is accurate, and that you are authorized to make decisions for your household, including adding family members and creating profiles for your own children. Children may use the Service only as members added by an adult account holder, as described in Section 4 and in our Privacy Policy. The Service is intended for users in the United States.
You are responsible for all activity that occurs under your account and for keeping your login credentials secure. You may sign in with an email and password or with a supported third-party sign-in such as Google. You agree to provide accurate account information, to keep it current, and to notify us promptly at hello@tendily.com of any suspected unauthorized use of your account. We are not liable for losses arising from your failure to safeguard your credentials.
Tendily is a "family operating system" — a subscription application that helps a household organize daily life through modules such as pantry and inventory, grocery lists, recipes, and meal planning, with additional modules offered over time. We may add, change, or discontinue features, and we may impose or adjust limits on the Service, at our discretion. We will not make material adverse changes to paid features you are actively subscribed to without reasonable notice.
Tendily lets you create a household and invite members using a family access code. As the account holder, you are responsible for whom you invite, how your access code is shared, and the profiles you create — including profiles for your own children. Anyone who holds your family code can view and edit your household's content, so share it only with people you trust; you can revoke or regenerate a code, and remove members, from within the app.
By adding a child to your household, you represent and warrant that you are that child's parent or legal guardian and that you consent, on the child's behalf, to our collection and use of the child's information as described in our Privacy Policy. A family access code is only a means of joining a household — it is not, by itself, parental consent. Our handling of children's information and how we obtain verifiable parental consent are described in the Privacy Policy.
Tendily offers a free tier and a paid subscription, Tendily Plus. Certain features require an active Tendily Plus subscription. The following applies to paid subscriptions:
You agree not to misuse the Service. You will not, and will not attempt to: (a) violate any law or regulation, or infringe the rights of others; (b) access accounts, data, or systems that are not yours, or probe or breach security or authentication measures; (c) disrupt, overload, or interfere with the Service, or reverse-engineer, decompile, or scrape it except as permitted by law; (d) upload or transmit malicious code, or content that is unlawful, harmful, harassing, or infringing; or (e) use the Service to harm or exploit any person, including any child. We may investigate suspected violations and may suspend, limit, or terminate accounts that violate these Terms or that create risk or legal exposure for us or others.
As between you and Tendily, you retain ownership of the content you and your household members add to Tendily ("Your Content"). You grant Tendily a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and display Your Content solely to operate, provide, secure, and improve the Service for you and your household — including the automated feature processing described in the Privacy Policy (such as categorizing items or parsing a recipe you import). This license ends when Your Content is deleted from the Service, except for residual copies retained for a limited time in routine backups or as required by law. You are responsible for Your Content and represent that you have the rights necessary to provide it.
If you send us ideas, suggestions, or feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or obligation to you. We appreciate feedback, but you are not required to provide it.
Tendily provides convenience features such as food freshness and expiration estimates, storage suggestions, food-storage facts, recipe parsing, meal and shopping suggestions, and other automated suggestions. These features are provided for general informational and organizational convenience only. They are estimates and suggestions — not guarantees, and not food-safety, medical, health, nutritional, financial, or other professional advice. Freshness and expiration indicators may be inaccurate and do not replace manufacturer date labels, your own inspection, or official food-safety guidance. Always use your own judgment before consuming, discarding, purchasing, or otherwise relying on any item, and follow the guidance of qualified authorities (for example, USDA and FDA food-safety guidance). You are solely responsible for the decisions you make using the Service.
The Service, including its software, design, text, graphics, the Tendily name and logo, and other brand features, is owned by Tendily or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your household's personal, non-commercial use, subject to these Terms. We reserve all rights not expressly granted. You may not use our name or brand features without our prior written permission.
The Service relies on third-party providers (for example, Google for sign-in and Stripe for payment processing) and may link to third-party content or services. We do not control and are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY ESTIMATE OR SUGGESTION THE SERVICE PROVIDES WILL BE ACCURATE OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TENDILY AND ITS OWNERS, MEMBERS, AND PERSONNEL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR YOUR RELIANCE ON ANY ESTIMATE OR SUGGESTION IT PROVIDES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
You agree to defend, indemnify, and hold harmless Tendily and its owners, members, and personnel from and against any third-party claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Service, Your Content, or your violation of these Terms or of any applicable law or third-party right.
You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its users. On termination, your right to use the Service ends; provisions that by their nature should survive (including content-license limits, disclaimers, limitation of liability, indemnification, and the sections below) will survive. Deletion of your data on termination is handled as described in the Privacy Policy.
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Except where prohibited by applicable law, you and Tendily agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Michigan, and you consent to the personal jurisdiction of those courts. Nothing in this section deprives you of the protection of any mandatory consumer-protection law of the state where you reside, or of your right to bring a qualifying claim in small-claims court.
We may update these Terms from time to time. If we make a material change, we will provide reasonable notice — for example, by email to account holders or an in-app notice — and update the "Last updated" date above. Changes take effect when posted unless stated otherwise, and your continued use of the Service after a change means you accept the updated Terms. If you do not agree to a change, you may stop using the Service and cancel.
